These Terms & Conditions (“Terms”) govern your use of the Fxvamp website (https://www.fxvampp.com) and your purchase and use of any products, services or content provided by Fxvamp (collectively, the “Services”).

By accessing the Site, purchasing a product, or using any Fxvamp Service, you agree to be bound by these Terms. If you do not agree, please do not use the Site or Services.

Fxvamp is operated from Australia, but we provide products and information to customers worldwide.

2. Eligibility & general use

By using this Site or purchasing any product, you confirm that:

• You are at least 18 years old, or the age of majority in your jurisdiction.

• You have the legal capacity to enter into binding contracts.

• You will use the Site and Services for lawful purposes only and in accordance with these Terms.

We may refuse service, cancel orders, or restrict access at our discretion if we believe these Terms are being breached or misuse is occurring.

3. Nature of products – digital, software & information only

Fxvamp provides digital products and informational content, including but not limited to:

• MetaTrader Expert Advisors (EAs) and indicators

• Trading dashboards, tools and templates

• Guides, PDFs, videos and educational material

No physical goods are shipped.

Upon purchase, you typically receive:

• Download link(s)

• License / activation details (if applicable)

• Setup or user instructions

You are responsible for ensuring you have:

• A compatible platform (e.g. MT4, MT5, VPS, broker account, etc.)

• Sufficient technical knowledge to install and operate the EAs/tools or willingness to follow the provided documentation.

4. License & permitted use

Unless otherwise stated, when you purchase an EA or digital product from Fxvamp, you are granted a limited, non-exclusive, non-transferable license to use the product for your own personal or internal business trading, subject to these Terms.

You may not:

• Resell, redistribute, repackage or rebrand our products as your own.

• Share, lease, lend, or transfer the EA or license to others, except where specifically allowed by Fxvamp.

• Attempt to reverse engineer, decompile or modify the source code (unless expressly permitted by law and applicable license terms).

• Use the product to build a competing service or product.

We reserve the right to disable or revoke licenses in cases of suspected abuse, piracy or breach of these Terms.

5. Account, orders & accuracy of information

You agree to provide accurate, current and complete information during checkout and when contacting support (e.g. name, email, MetaTrader account number for activation).

You are responsible for:

• Maintaining the security of your email, platform credentials and any download links.

• Ensuring that any details you provide for license activation (e.g. account numbers) are correct.

If incorrect information is provided, we may not be able to activate or support your product until updated details are supplied.

6. Pricing, payment & taxes

Prices are displayed in the currency shown on the Site and may change at any time without notice.

• Payment is processed securely by third-party payment providers (e.g. Stripe, PayPal, etc.).

• You are responsible for any bank fees, currency conversion fees or local taxes that may apply.

• Where required by law, applicable taxes (e.g. GST/VAT) may be included or added at checkout.

We are not responsible for delays or issues caused by your bank, payment provider or internet connection.

7. Delivery & access

After successful payment:

• You will be redirected to a confirmation / thank you page and/or

• You will receive an email with download links, license information and/or setup instructions.

If you do not receive your product within a reasonable time:

• Check spam/junk folders.

• Ensure the email address entered during checkout is correct.

8. Refunds & returns

Because Fxvamp products are digital and downloadable and can be accessed immediately after purchase, all sales are generally final and non-refundable, except where required by applicable Australian Consumer Law or other mandatory laws.

We may, at our sole discretion, consider a refund or partial refund in limited situations, for example when:

• The product cannot reasonably be used due to a verified technical issue on our side that we are unable to resolve within a reasonable timeframe; or

• You were charged more than once for the same order.

Refund requests should be sent to [support@fxvamp.com] with your order details and a clear explanation. Approval or refusal of any refund request is at Fxvamp’s discretion, subject to your non-excludable rights under Australian Consumer Law.

9. No financial advice

All content and products provided by Fxvamp, including EAs, indicators, dashboards, videos and written material:

• Are for educational and informational purposes only.

• Do not constitute financial, investment, legal, tax or other professional advice.

• Do not recommend any specific broker, instrument, trade, strategy or risk level.

You are solely responsible for:

• Your own trading decisions and risk management.

• Seeking independent financial advice from a licensed professional if needed.

• Ensuring that any trading activity complies with the laws and regulations in your jurisdiction.

10. Trading risk disclaimer

Trading forex, indices, commodities, CFDs and other financial instruments involves significant risk of loss and is not suitable for all investors.

By using Fxvamp products or strategies, you acknowledge and agree that:

• Past performance, including hypothetical or simulated results, does not guarantee future outcomes.

• Automated systems (EAs) can fail due to market conditions, broker issues, slippage, latency, VPS outages, incorrect settings and other factors beyond our control.

• You may lose some or all of your trading capital.

You use Fxvamp products entirely at your own risk. Fxvamp will not be liable for any loss or damage (direct or indirect) arising from your trading activity.

11. Prop firms & third-party services

Fxvamp is not affiliated with, endorsed by, or sponsored by any proprietary trading firm, broker, exchange or platform (including but not limited to FTMO, Topstep, etc.), unless explicitly stated.

Any mention of third parties is for illustration only. It is your responsibility to:

• Review and comply with any rules, terms or conditions set by your broker, prop firm or platform.

• Ensure your use of any EA or strategy is allowed under their agreements.

We are not responsible for any actions taken by third parties, including account closures, rule violations, or changes to their terms that affect your trading.

12. Intellectual property

Unless otherwise stated:

• All content on the Site, including text, graphics, logos, icons, images, videos, software, code and digital products, is the intellectual property of Fxvamp or its licensors.

• You receive a license to use the purchased products as described in Section 4, but you do not own the underlying code or IP.

You must not, without prior written permission:

• Copy, reproduce, modify, distribute, transmit, publicly display or create derivative works from our content or products, except as expressly permitted.

We reserve all rights not expressly granted in these Terms.

13. Acceptable use & prohibited behaviour

You agree not to:

• Use the Site or Services in any way that breaches any applicable law or regulation.

• Attempt to gain unauthorised access to the Site, servers, or any other systems or networks connected to Fxvamp.

• Upload or distribute malicious software, viruses, or any harmful code.

• Use any automated systems (bots, scrapers) to access the Site in a manner that burdens or disrupts our infrastructure.

• Harass, abuse or harm other users or Fxvamp staff.

We may restrict or terminate access and/or licenses if we have reason to believe these rules are being violated.

14. Limitation of liability

To the maximum extent permitted by law (including the Australian Consumer Law):

• Fxvamp and its owners, employees, contractors and affiliates are not liable for any loss, damage, cost or expense of any kind (including indirect, consequential, special or punitive damages) arising out of or related to:

  • Use of, or inability to use, the Site or Services

  • Trading decisions made using Fxvamp products

  • Errors, omissions, interruptions, delays, defects, or technical issues

  • Actions of third parties (brokers, prop firms, payment providers, hosting providers etc.)

Where our liability cannot be excluded (e.g. due to non-excludable consumer guarantees under Australian law), our liability is limited, at our option, to:

• Re-supplying the relevant Services; or

• Refunding the amount paid for that part of the Services.

15. Indemnity

You agree to indemnify and hold Fxvamp and its owners, employees and contractors harmless from any claims, losses, damages, liabilities, costs and expenses (including legal fees) arising out of:

• Your use or misuse of the Site or Services

• Your breach of these Terms

• Your violation of any law or third-party rights

16. Privacy

Your use of the Site and Services is also governed by our Privacy Policy, which explains how we collect, use and protect your personal information.

17. Changes to the Site, products & Terms

We may:

• Update, modify or discontinue any part of the Site or Services at any time; and

• Update these Terms from time to time.

18. Governing law & jurisdiction

These Terms are governed by the laws of Australia, and, where relevant, the state or territory of [e.g. Queensland], without regard to conflict-of-law principles.

These Terms, together with our Privacy Policy and any product-specific license terms or notices, constitute the entire agreement between you and Fxvamp regarding your use of the Site and Services and supersede all prior understandings or agreements.
